In today’s session, the Government defined the wording of the Draft Act Ratifying the Arbitration Agreement between the Government of the Republic of Slovenia and the Government of the Republic of Croatia and submitted it for discussion and adoption to the National Assembly.  In addition, the Government also defined the text of a proposal for issuing an opinion on the compliance of the Arbitration Agreement with the national Constitution and submitted it to the Constitutional Court of Slovenia. By signing the Arbitration Agreement, the two countries undertook to resolve the sea and land border dispute by way of ad hoc arbitration. In doing so, the parties confirmed their commitment to a peaceful settlement in the spirit of good neighbourly relations and in line with the expression of their vital interests.

On this occasion, the Government adopted a declaration with regard to the Arbitration Agreement between the Government of the Republic of Slovenia and the Government of the Republic of Croatia, signed on 4 November 2009 in Stockholm. Considering the sovereign right of any country to issue unilateral statements and in view of the fact that Slovenia took note of Croatia’s intention to issue a unilateral statement with regard to the Arbitration Agreement, Slovenia declares that it disagrees with the content of Croatia’s unilateral statement. The Republic of Slovenia also declares that according to international law the unilateral statement given with regard to the Arbitration Agreement does not prejudice the Agreement’s content and considers the declaration by Croatia inadmissible and entirely void of legal effect in relation to further proceedings.
